The Hudson river Trust website says 'Skatepark: Opening in May'. That's direct from the source, although May could be tomorrow, or the end of the month, obviously.
The park is going to be free for sure, and pad/helmet rules have not been made public. HOWEVER, it is NOT park of the NYC parks and rec, meaning they don't have to adhere to the nonsensical pad/helmet rules that those parks have. Let's cross our fingers that it's use at your own risk (no pads).
Also, I think this has been mentioned on here, but just down the path a bit in Tribeca, Pier 25 will also have a skatepark built by California Skateparks. It is already under construction and will open this Fall. This means that there will be two sick skateparks within close proximity to each other right on the river. Get stoked.
